Soal Surf & Sky High Surf Academy
Soal Surf: the organization that applies these general terms and conditions.
Client: any person or entity purchasing a service or product from Soal Surf.
Participant: any individual involved in activities or arrangements as described in the agreement.
Arrangement: services, activities, and facilities offered by Soal Surf, including but not limited to equipment rental or sales, transport, instruction, and supervision.
These terms and conditions apply to all offers and agreements between Soal Surf and a contracting party, unless explicitly agreed otherwise in writing.
All agreements between Soal Surf and a contracting party are governed exclusively by Dutch law.
Agreements between Soal Surf and the contracting party may be concluded orally or in writing.
Any person booking an activity on behalf of others is fully responsible for those participants.
Written agreements may be confirmed via email, WhatsApp, SMS, or an online booking system.
Soal Surf is not liable for any damage, including loss of income or personal injury, unless caused by intent or gross negligence.
The full price must be paid before the start of the activity via the online booking system or on-site at the surf school.
Products for which a quotation or invoice has been issued must be paid within the specified payment term prior to delivery.
Reservations for group activities (such as corporate events or children’s parties) are final after written confirmation by Soal Surf and receipt of a 20% deposit from the contracting party.
Every participant taking part in activities at Soal Surf accepts the inherent risks and dangers associated with these activities.
By participating, the participant agrees to the level and intensity of the activity.
Any physical limitations or health risks must be disclosed to Soal Surf prior to participation.
Soal Surf reserves the right to exclude participants if their health condition poses a risk to themselves or others.
Surf lessons involve inherent risks, including the risk of physical injury. Participants must maintain full attention and concentration during lessons and avoid unnecessary risks.
Participants are personally responsible for their own safety and for assessing risks before taking part in activities.
Participants must follow all instructions given by instructors and use the provided equipment (including wetsuit, impact vest, lycra, helmet, harness, kite, windsurf sail, wing, foil, and kiteboard) strictly as instructed. Equipment may not be transferred to others.
The use of or being under the influence of alcohol and/or drugs during activities is strictly prohibited.
Surf lessons are available to participants from the age of nine, provided they do not suffer from any medical or psychological condition that could endanger their own safety or that of others.
Jewelry or other items (such as earrings, necklaces, bracelets, etc.) that may pose a safety risk must not be worn during lessons.
Long hair must be securely tied back with an elastic band.
In the event of cancellation or rescheduling due to unfavorable weather conditions or other reasons, no refunds will be issued. The lesson may be rescheduled via the booking system. Lessons remain valid for two years.
Lessons cannot be rescheduled or cancelled within 24 hours prior to the scheduled start time.
Soal Surf is not liable for any damage, loss, theft, injury, or accidents occurring during activities, unless caused by intent or gross negligence.
Rented equipment, including wetsuits, must be returned at the agreed time. Late returns may result in additional charges.
Soal Surf reserves the right to amend or supplement these general terms and conditions. Amended terms apply to all current and future agreements.
If any provision of these terms and conditions is declared null or void, the remaining provisions shall remain fully valid and enforceable.
